These are the Terms and Conditions of Sale (“T&Cs”) that apply to your use of our website and all orders made through our website, so please read them carefully. By using this website or purchasing any item from us, you agree to be bound by these T&Cs and acknowledge that they will form the basis of any contract of sale between us and you. 

Our website is hosted by Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

You can find everything you need to know about us, Stubble & Co, and our products on our website before you order. We also confirm the key information to you in writing before you order on our website order page.

When we refer to “we” or “us”, we mean Stubble & Co. Where we refer to “you” or “your” we mean you, the customer. 

When you buy from us you are agreeing that:

  • We only accept orders when we've checked them.
  • Sometimes we reject orders.
  • We charge you when you order.
  • We pass on increases in VAT.
  • We're not responsible for delays outside our control.
  • Products can vary slightly from their pictures.
  • You have a legal right to change your mind [plus extra rights under our guarantee OR and however you bought you have rights under our guarantee].
  • You have rights if there is something wrong with your product.
  • We can change products and these terms.
  • We can end our contract with you.
  • We don't compensate you for all losses caused by us or our products.
  • We use your personal data as set out in our Privacy Notice.
  • You have several options for resolving disputes with us.
  • Other important terms apply to our contract.

We only accept orders when we've checked them 

Your placement of an order constitutes an offer to purchase items from us. When processing your order, we will contact you by email to confirm we've received your order. This does not mean that your order has been accepted by us. We will then send you a separate email to confirm your order has been dispatched. At this point your offer to purchase is accepted by us and a contract for sale is formed. 

In order to purchase items on our website, you must be the holder of a valid credit or debit card and provide us with such personal information as we reasonably require to process your order (such as your name, phone number, email address, delivery address etc). 

Items placed in your online shopping cart are not reserved for you and can be purchased by other customers. 

Sometimes we reject orders

We reserve the right to refuse orders for any reasonable reason at any time. 

Sometimes we reject orders, for example, because a product is unexpectedly out of stock, because you are located outside our delivery areas, as stated on our website, or because the product was mispriced by us. When this happens, we let you know as soon as possible and refund any sums you have paid. 

All items purchased by you must be for your personal use only and are not to be purchased for resale or other commercial gain. 

We charge you when you order 

We charge you for the full price of your item and apply any delivery or tax charges at the time you order. Our Delivery and Shipping Policy contains full details of any applicable delivery charges and can be found here: https://www.stubbleandco.com/pages/shipping-delivery. Should we not be able to fulfil your order we will reimburse any and all relevant amounts to the payment method used for your purchase. 

We pass on increases in VAT

If the rate of VAT changes between your order date and the date we supply the product, we adjust the rate of VAT that you pay, unless you have already paid in full before the change in the rate of VAT takes effect. This only applies in cases where the customer is liable to pay VAT (most commonly because the customer is UK-resident or the item is being shipped to the UK). 

We're not responsible for delays outside our control 

If our supply of your product is delayed by an event outside our control, we contact you as soon as possible to let you know and do what we can to reduce the delay. As long as we do this, we won't compensate you for the delay, but [if the delay is likely to be substantial you can contact us via email at hello@stubbleandco.com to end the contract and receive a refund for any products you have paid for in advance, but not received. 

Products can vary slightly from their pictures 

A product's true colour may not exactly match that shown on your device or in our marketing or its packaging may be slightly different. We do our best to provide accurate images but naturally there can be some variation between what you see online and the product in life. 

After making your purchase on our website, you have a legal right to change your mind plus the extra rights we provide under our simple goodwill guarantee

Your legal right to change your mind. For most of our products, you have a legal right to change your mind about your purchase for up to 14 days after purchase and receive a refund of what you paid for it, including any delivery costs you have paid. 

However, we extend this statutory right and offer a full refund on items returned to us for any reason for a period of up to 30 days after the product was dispatched by us to you. All returned items must be received by us on or before the 30 day deadline. 

We offer free returns for customers in the UK and US and discounted shipping options for customers in other locations worldwide. 

All items returned to us must be in unused condition. We can’t accept a return if it arrives used or damaged due to improper packaging and we ask that, where possible, items are returned in their original packaging. 

Our goodwill guarantee. In addition to the above, we offer a goodwill guarantee on all of our products for a period of two years after the date of dispatch of your product by us to you. If you experience an issue with the quality of your product during this period, simply let us know of the issue and we will either repair or replace the product free of charge.

Returning an item to us. Read our Returns Policy, https://www.stubbleandco.com/pages/what-if-i-need-to-return-an-order. Please visit our returns portal https://www.stubbleandco.com/a/returns to process your return and receive a prepaid return label. If you have any issues with this process you can email us at hello@stubbleandco.com with your order number and confirmation of the issue.

Once you’ve sent your item to us, please ensure you keep your postage receipt and tracking information until we confirm safe receipt and treatment of your return. 

We refund you within 14 days of receiving your product back from you. We refund you by the method you used for payment. We don't charge a fee for the refund.

These guarantees extend the legal rights you have if there is something wrong with your product (for more on those rights see “You have rights if there is something wrong with your product” below) and are offered in addition to your statutory rights. 

You have rights if there is something wrong with your product

If you think there is something wrong with your product, you must contact us at hello@stubbleandco.com. We honour our legal duty to provide you with products that are as described to you on our website and that meet all the requirements imposed by law. Your legal rights are summarised below. These are subject to certain exceptions. For detailed information please visit the Citizens Advice website www.citizensadvice.org.uk. Remember too that you have several options for resolving disputes with us, see this section below.

Summary of your key legal rights 

The Consumer Rights Act 2015 says goods sold must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:

  • Up to 30 days: if your goods are faulty, then you can get a refund.
  • Up to six months: if your goods can't be repaired or replaced, then you're entitled to a full refund, in most cases.  
  • Up to six years: if your goods do not last a reasonable length of time you may be entitled to some money back.

We can change product and these terms

Changes we can always make. We can always change a product:

  • to reflect changes in relevant laws and regulatory requirements governing the sale of consumer goods or requiring us to make changes to our products; and
  • to make minor technical adjustments and improvements to our products. 

We don't compensate you for all losses caused by us or our products

We're responsible for losses you suffer caused by us breaking this contract unless the loss is:

  • Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).
  • Caused by a delaying event outside our control. As long as we have taken the steps set out in the section “We're not responsible for delays outside our control”. 
  • Avoidable. Something you could have avoided by taking reasonable action. 
  • A business loss. It relates to your use of a product for the purposes of your trade, business, craft or profession.

You have several options for resolving disputes with us

Our complaints policy. In the first instance, please get in touch with us at hello@stubbleandco.com to let us know about any issue you may be experiencing with either your product or our service. We will do their best to resolve any problems you have and to ensure you are happy with your product and the service received. 

You can go to court. These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in. 

Other important terms apply to our contract

Warranties. You warrant and represent to us that:

  1. you are legally capable of entering into binding contracts;
  2. you have full authority, power and capacity to agree to these T&Cs;
  3. all of the information that you provide to us in connection with your order is true, accurate, complete and not misleading; and
  4. you will be able to take delivery of the products in accordance with the delivery and shipping requirements of the delivery service transporting your items. 

We warrant and represent to you that:

  1. we have the right to sell the products;
  2. the products are sold free from any charge or encumbrance, except as specified in these T&Cs;
  3. you will enjoy quiet possession of the products except as specified in these T&Cs;
  4. the products will correspond to any description published on our website; and
  5. the products will be of satisfactory quality. 

All our warranties and representations relating to the supply of our products are contained in these T&Cs. To the maximum extent permitted by law, all other warranties and representations are excluded. 

Intellectual Property. The content of the website is the property of Stubble & Co and is protected by UK and international copyright laws. The trademarks used on our website are the registered and unregistered marks of Stubble & Co and are protected by UK and international trademark laws. You acknowledge and agree that the material and content contained in within the website if made available for your personal non-commercial use. You agree not to copy, reproduce, transmit, publish, display distribute or create derivative works of such material and content for commercial purposes. 

Nobody else has any rights under this contract. This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesn’t mean we can't do it later.

e-Gift Card Terms of Use

General Terms

  • E-gift cards can only be purchased and redeemed on stubbleandco.com
  • E-gift cards are only available in the UK using GBP
  • E-gift cards are valid for 12 months from the date of purchase
  • The minimum value for an e-gift card is £25 and the maximum is £150
  • E-gift cards can be used as full or partial payment for products
  • Any remaining balance will be stored on the e-gift card for future use
  • E-gift cards cannot be used to purchase other e-gift cards
  • E-gift cards cannot be redeemed for cash or returned for a refund unless required by law
  • E-gift cards are not involved in promotions and discounts cannot be applied when purchasing an e-gift card. This includes sales and gift with purchase promotions

Delivery and Usage

  • E-gift cards will be delivered via email to the recipient's email address provided during purchase
  • The purchaser is responsible for providing the correct email address
  • E-gift cards contain a unique code that must be entered at checkout to redeem
  • Lost or stolen e-gift cards should be reported to hello@stubbleandco.com immediately
  • We are not responsible for lost, stolen, or unauthorised use of e-gift cards

Returns and Refunds Involving E-Gift Cards

  • Products purchased with an e-gift card that are returned in accordance with our returns policy will be refunded to a new e-gift card
  • If a purchase was made using both an e-gift card and another payment method, any refund will first be applied to the alternative payment method used, with any remaining balance refunded to a new e-gift card
  • E-gift card purchases are generally non-refundable except where required by applicable law
  • Expired e-gift cards cannot be reactivated, refunded, or extended

Technical Requirements

  • To purchase and redeem e-gift cards, you must have a valid email address and internet access
  • E-gift cards must be redeemed through our website checkout process
  • We are not responsible for technical issues outside our control that may affect the delivery or usage of e-gift cards

For items purchased using an e-gift card, refunds will be processed according to the following:

  • Full e-gift card purchases will be refunded to a new e-gift card
  • Split payment purchases will be refunded first to the additional payment method used, with any remaining balance refunded to a new e-gift card

 

Mobile Terms of Service

The Stubble & Co mobile message service (the "Service") is operated by Stubble & Co (“Stubble & Co”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Stubble & Co’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Stubble & Co through your mobile service provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Stubble & Co. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your mobile service provicer. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your mobile service provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18447300135 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Stubble & Co mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The mobile service provider supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
